General Terms & Conditions

Payment

  • Agreement to proceed with works is also acceptance of these terms and conditions
  • The customer shall pay all outstanding amounts within 7 days of receiving Invoice.
  • If the payment to ALZ Group is not paid by the due date of outstanding invoice, without prejudice to any other right or remedy, all money outstanding shall attract interest on daily balances until paid at the rate of 10% per annum calculated daily and such interest shall be recoverable together with any other outstanding monies from the customer.
  • Quotations are valid for 7 Days from the date of Quotation.

 Warranty

  • All workmanship completed by ALZ Group comes with a 10 year warranty
  • ALZ Group does not warrant the products sold to Customer
  • Warranty is void where products have been altered or tampered with by anyone other than ALZ Group or its current employees.
  • The Customer is responsible for the expense of making a claim under this Warranty. To make a claim under the Warranty the Customer can contact the manufacturer directly or ALZ Group if within the System Warranty period.
  • ALZ Group requires the Customer to provide a description of the defect or damage by post, telephone or email.
  • ALZ Group will assess the validity of the Warranty claim and provide an appropriate remedy.
  • If ALZ Group finds the Warranty Claim is not legitimate, the Customer must pay any expenses incurred by ALZ Group in relation to the Warranty Claim.

 Service calls

  • You must give us 48 hours’ minimum notice of any non-emergency service call after which we will arrange a time and date for a service call.
  • Service calls will generally be carried out during normal working hours only (8am – 4.00pm Monday to Friday).
  • A minimum service charge of $180.00 per hour plus the cost of all parts and all travel and transport costs is payable for all service calls. For service calls after hours, an additional service charge of not less than $100 applies.
  • Where we carry out a service call for a problem with the Goods and Services which is covered by a warranty or a consumer guarantee under the ACL, you will not be charged the service charges.
  • Where we carry out a service call which is not covered by a warranty or a consumer guarantee under the ACL, or where there is otherwise no problem with the Goods or Services, you will be charged the service charges referred to in this section.

 Ownership

  • Goods remain the property of Seller until payment is received
  • Ownership of the System passes to you upon final payment of the total amounts outstanding.
  • In the event that you default in the payment of all or part of the total amount payable, you hold the System as bailee for ALZ Group and ALZ Group will remain the legal and beneficial owner of the goods.
  • Until you pay the full purchase price, ALZ Group will be the custodian of the goods. The following points must also be adhered to:
    • You must under no condition sell, assign, change, pledge, lien or other encumbrance to be created in relation to the goods.
    • If you sell any of the goods while they remain the property of ALZ Group, the proceeds from the sale are owed to ALZ Group and must be paid to ALZ Group immediately.
    • You must keep the goods in good condition and protect them from any damage.
    • Upon installation or otherwise taking the possession of the goods, any risk of loss or damage in the goods will pass to you.
  • Should payment remain due and unpaid for a period exceeding thirty (30) days from completion of the work then the Customer authorizes and directs ALZ Group and any employees and contractors of the Company to enter the Customer’s property where the system is installed and remove the system.
  • The Customer will be liable to ALZ Group for the costs of removing the goods from the Customer’s property. In exercising their right, the Company and any employees and contractors of the Company will use reasonable care to not unduly interfere with the right and comfort of the Customer.
  • The Customer will provide to the Company and any employees and contractors reasonable assistance in removal of the systems. The removal of the system will not in any way reduce the amount the Customer is required to pay to the Company for the installation of the system and associated work.

 PRIVACY ACT ACKNOWLEDGEMENT AND CONSENT

  • The credit applicant grants permission to the credit provider or their agent to:
  • Disclose to a credit reporting agency certain personal information about me/ us including; identity particulars; the amount of credit applied for; amounts outstanding, including interest; payments which may become more than 60 days overdue; any serious credit infringement which the credit provider believes has been committed.
  • Obtain from a credit reporting agency a report containing personal credit information about me/us and, a report containing information about my/our commercial activities or commercial credit worthiness, to enable the credit provider to assess this application for credit.
  • Give to and obtain from any credit provider/s that may be named in this application or in a report held by a credit reporting agency information about my/our credit arrangements, including information about my/our credit worthiness, credit standing, credit history, credit capacity, for the purpose of assessing an application for credit, or notifying by me/us.
  • This consent shall remain in force so long as there is an amount owing to the credit provider.

 

Solar Terms & Conditions

FORMATION OF AGREEMENT

We may amend these Terms and Conditions at any time.

An agreement for the supply and purchase of Goods and Services (Agreement) shall be in accordance with these terms and conditions upon:

You paying the deposit for the Goods and Services.

And your acceptance of the Quote or of these Terms and Conditions.

The Agreement may only be amended in writing, signed by you and by us.

 PURCHASE PRICE

Your quote includes a point of sale discount on the condition that you agree to assign the right to create STCs to the companies’ nominated agent.

The Purchase price for all goods and services is set out in the quote, the total price is inclusive of GST unless otherwise expressly stated.

Quotations are valid for 7 Days from the date of Quotation.

The customer shall pay all outstanding amounts within 7 days of receiving Invoice.

If we need to vary the Purchase Price because:

The information provided by you was incorrect or incomplete; or

You failed to provide information that we informed you was required by us within the time limits required by us; or

You are not entitled to a discount in the form of a government or commonwealth rebate.

We will advise you of the variation and you may either accept the varied Purchase Price or cancel the Agreement.

 CANCELLATION BY YOU

If you cancel the Agreement:

You may cancel the Agreement without reason by notifying us within 10 business days from and including the day after you entered into the Agreement (Cooling off Period). If you cancel the Agreement during the cooling-off period we will refund in full all amounts paid by you up to and including the date of cancellation less an administration fee of $100.

If you cancel within 48 hours of your scheduled installation date all reasonable amounts incurred by us in preparing for your installation will be due and payable by you to us. We may, in our absolute discretion, withhold these amounts from any amounts paid by you.

 GOVERNMENT REBATES AND STCs

You may be entitled to receive a rebate or other benefit from the Commonwealth or State Government, including STCs, as a result of the purchase and installation of your System. For the avoidance of doubt, ALZ Group does not guarantee that you will be eligible for or receive any rebate, benefit or right, as a result of purchasing your System.

In the event that:

You choose not to or do not do all things necessary to, assign the STCs to the companies’ nominated agent

You have not received the payment of any grant, rebate or benefit incorporated in the Purchase Price; or

We are unable to create the number of STCs anticipated in the Quote you must:

Pay the amount of that grant, rebate or benefit or the amount equal to the value of the point of sale discount given (or the balance which remains outstanding) to us within 7 days of us notifying you of the additional amount being payable.

Your quote includes a point of sale discount on the condition that you agree to assign the right to create STCs to the companies’ nominated agent.

Where the price of the STC’s is lower than the amount quoted the customer shall be liable for the difference to ALZ Group

You acknowledge that a government may, at any time, make legislative changes which may affect your eligibility for, or entitlement to, any incentives, subsidies, and grants, rebates, STCs or other benefits. We will not be liable to you in the event that such legislative changes occur and you expressly exclude us from any such liability.

You acknowledge that in certain circumstances a government may require you to repay a grant, rebate or other benefits. Except where we have breached our obligations to you, we will have no responsibility to you in the event that you are required by a government to repay a grant, rebate or other benefits.

 SYSTEM

Solar power systems installed where shading from trees and vegetation and or buildings and structures are involved will result in reduced production of the system.

Systems installed contrary to the best advice of the Company may result in reduced efficiency, production and life of the system and if the system is installed contrary to such advice then the Customer accepts such negative impacts.

Where the space/area allocated for the specific system quoted is altered the system owner, therefore, indemnifies the company of any defects arisen as a result. The customer also voids all warranties and Guarantee given by the company.

The position of the system and all relevant equipment to be used has been explained in full to the Customer.

We can only install your System when your Energy Supply Authority supplies final approval and connection to the grid.

The system, other than for testing purposes must not be turned on to export to the grid until the supply authority has given permission to do so.

Customers with tiled roofs are required to five roof tiles at hand in case replacements are needed.

 SERVICE CHARGES

We will carry out service calls on the following conditions:

Where we carry out a service call which is not covered by a warranty or a consumer guarantee under the ACL, or where there is otherwise no problem with the Goods or Services, you will be charged the service charges referred to in this section.

Goods remain the property of Seller until payment is received.

Ownership of the System passes to you upon final payment of the purchase price and if applicable the creation of the STCs.

In the event that you default in the payment of all or part of the total amount payable, you hold the System as bailee for ALZ Group and ALZ Group will remain the legal and beneficial owner of the System.

Until you pay the full purchase price, you will be the custodian of the goods. The following points must also be adhered to:

If you sell any of the goods while they remain the property of Euro Solar, the proceeds from the sale are owed to ALZ Group and must be paid to ALZ Group immediately.

You must keep the goods in good condition and protect them from any damage.

Upon installation or otherwise taking the possession of the system, any risk of loss or damage in the System will pass to you.

Should payment remain due and unpaid for a period exceeding thirty (30) days from completion of the work then the Customer authorizes and directs the Company and any employees and contractors of the Company to enter the Customer’s property where the system is installed and remove the system.

The Customer will be liable to the Company for the costs of the Company removing the system from the Customer’s property. In exercising their right, the Company and any employees and contractors of the Company will use reasonable care to not unduly interfere with the right and comfort of the Customer.

The Customer will provide to the Company and any employees and contractors reasonable assistance in removal of the systems. The removal of the system will not in any way reduce the amount the Customer is required to pay to the Company for the installation of the system and associated work.

 SYSTEM MAINTENANCE

You will be provided with a system maintenance schedule.

You will be required to take all necessary steps to ensure the maintenance schedule is adhered to.

All maintenance provided by contractors/company’s etc. other than ALZ Group may not be warranted by ALZ Group. Warranty will be at ALZ GroupS discretion.

WARRANTY

The Customer is responsible for the expense of making a claim under this Warranty. To make a claim under the Warranty the Customer can contact the manufacturer directly or ALZ Group if within the System Warranty period.

ALZ Group requires the Customer to provide a description of the defect or damage by post, telephone or email.

ALZ Group will assess the validity of the Warranty claim and provide an appropriate remedy If you have not had the System serviced within the last 2 years of notifying ALZ Group of a Warranty Claim.

You will be required to pay for a System Assessment to be completed at the same time as the Warranty Claim work. ALZ Group will not book in any Warranty Claim work until the System assessment fee is paid.

If ALZ Group finds the Warranty Claim is not legitimate, the Customer must pay any expenses incurred by ALZ Group in relation to the Warranty Claim.

The customer acknowledges that all descriptive specifications, illustrations, drawings and data dimensions provided by us to you, or otherwise contained in our fact sheets, price lists and other advertising material, are approximate only.

The customer agrees that we may substitute or use alternative goods to the Goods referred to in the Quote, provided that such goods are of equal or better quality than the Goods referred to in the Quote and;

Warrant that you will be 18 years old or over prior to purchasing the Goods.

ALZ Group Pty Ltd terms and conditions also apply to any work done by ALZ Electrical.
